Introduction and Applicability
The below Terms and Conditions govern the use of this Website and the sale of any Product as featured on this Website. By making a purchase from, and using this Website you have agreed to these Terms and Conditions. Please make sure you have read and understood these Terms and Conditions when using this Website. Until an order is paid in full the Products belong to FLARROW, as registered at the Dutch Chamber of Commerce under number 65812875 and with VAT number NL125022165B01.
The below definitions are used throughout these Terms and Conditions:
Website: www.flarrowwatches.com and www.flarrow.co.
Buyer: A natural person of legal age that has paid their order in full and has therefore agreed to these Terms and Conditions.
Order: an agreement that is entered between FLARROW and the Buyer as soon as the Buyer has paid the order in full and FLARROW has accepted the order and its obligation to deliver the ordered Product(s).
Product: A FLARROW Product that is available for sale on this Website.
Personal Information and Privacy
FLARROW will save some of your information when shopping on this Website. FLARROW complies with the privacy regulations as recorded in the “ Wet Bescherming Persoonsgegevens” (the “Dutch Personal Data Protection Act”). You have the right to see, amend, or delete your personal information by logging in to your account on this Website.
FLARROW will store your data in a file. This data will be used to fulfill your order and is stored as long as deemed necessary to complete the order process. FLARROW treats all personal information confidential and will not be shared with third parties, except for when deemed necessary to complete the order process or for repair purposes.
FLARROW has the right to adjust prices, which may include additional costs. Product information such as photos may be changed at any time without notice. Product information, including photos, reflects the Product as accurately as possible. We reserve the right for any errors that may appear on this Website and cannot guarantee that all photos accurately reflect the Product’s true appearance and characteristics. Product photos may look different depending on the screen and colour settings on your computer or device.
Before placing an order on this Website please make sure that you are:
· Over 16 years old;
· An individual customer and not a professional reseller.
Any orders not made in your name or without another person’s consent that results in financial loss for that person or FLARROW will be reported to the police. All attempts at fraud will also be reported to the police. We have the right to change prices, correct incorrect prices on orders as well as on sales. We may also refuse to process, and therefore refuse to accept, a transaction for any reason or refuse service to anyone at any time at our sole discretion. We reserve the right to cancel a contract in the following situations, without the obligation to compensate the Buyer for any losses other than a refund of the amount received from the Buyer:
· In case we are unable to obtain authorisation for payment;
· In case the ordered Product is out of stock or unavailable;
· In case we suspect fraud;
· In case we have reason to believe your are under 16 years old;
· In case we suspect you may be a professional reseller;
· In case the pricing of a Product is incorrect;
· In case we could not deliver to the address provided;
· In case of an event outside of our control (Force Majeure).
FLARROW does not allow the purchase of Products from this Website for commercial, business or re-sale purposes. Hence, it is not possible to order more than 9 items at once. For more information please contact us at email@example.com.
As soon as we have received your order we will send you an order confirmation to the email address provided at the time of registration. It is therefore important that the email address is correct when placing your order. You can change your email address by logging in to your account on this Website. The order confirmation serves as a binding contract between the Buyer and FLARROW that are bound by these Terms and Conditions. The order confirmation (receipt) also serves as a guarantee of proof of purchase. Without the order confirmation we cannot accept any returns. In case you did not receive an order confirmation please contact firstname.lastname@example.org.
The following payment methods are currently accepted:
· American Express
By using a credit or debit card you confirm that the card is yours or that you have been authorized by the owner to use it. All credit or debit cardholders are subject to validation checks and authorization by the card issuer. No additional costs are charged for the use of a credit or debit card. FLARROW does not handle any credit card numbers. These Terms and Conditions apply as soon as your payment has been processed. We will not be liable for any delay or non-delivery if the card issuer, for any reason, refuses your payment.
Price, Currency & VAT
If you are ready to order, please select your country of residence first. By changing the country the prices will be automatically changed in the currency of your country. All prices on this Website include Dutch VAT, which is 21% of the price. In case the order will be shipped to a country that is outside the EU the Dutch VAT will be removed at checkout. If a Product is shipped to a country outside the EU, you may be subject to import duties and taxes. These duties and taxes will be levied at the time of delivery at the specified address. You are responsible for paying the import duties and taxes. FLARROW has no control of these additional charges as they differ per country. Please contact your local customs office for more information. The deduction or inclusion of VAT is to meet the recommended retail price.
If you return a Product from outside the EU you will bear all the costs related to import / export taxes, duties and/ or customs that may be incurred by FLARROW in order to receive your return shipment. The total sum of these costs will be deducted if we give you a refund.
Delivery and Cancellations
FLARROW ships worldwide. Deliveries are made in cooperation with several couriers and their partners in other countries around the world.
Please make sure that your address and contact details are correct before finalising your order, as you are responsible for providing this information. FLARROW cannot be held responsible for the (partial) loss of your order in case anything goes wrong with the shipment as a result of an incorrect delivery address. We may contact you if we require additional information to be able to ship your order. This could lead to a delay in shipment. Once your order is dispatched we will send you a tracking code with which you can track your order. All delivery terms (shipping days, delivery times, etc.) as mentioned on this Website are estimates and cannot be regarded as final or guaranteed delivery terms. FLARROW cannot be held responsible for any delays caused by events that are outside of our control, such as national holidays. If we receive a package that has not been collected or if the Buyer rejected the order at delivery, we reserve the right to charge the Buyer for all costs that we have incurred from handling your order and shipment. In this case we will send you an invoice for these costs, which is to be paid within 10 business days.
In case an order that has been dispatched goes missing or if the Buyer claims they did not receive the order (despite carrier information such as tracking data indicating otherwise) we will start the complaint procedure of the responsible carrier. The outcome of the complaint procedure will be awaited before any refund or re-shipment will take place. The Buyer is responsible to fully cooperate during the complaint procedure. If, after the complaint procedure has been finalised, it appears that the order has gone missing as a result of a mistake by the responsible carrier we will confirm with the Buyer if they would like a refund or have us ship the same Product again.
If you receive a Product that you did not order you must contact us at email@example.com at your earliest convenience and within 24 hours after receiving the Product(s). It is your responsibility to return the Product first before we can ship you the correct Product. In this case you will be reimbursed for your shipping expenses.
You have the right to cancel your purchase and return the ordered Product(s) by contacting us at firstname.lastname@example.org or by using the contact form on the Website within 14 days after receiving your order. In case you decide to cancel your purchase you will be responsible for returning the Product unworn and unused, in the same condition including the protective stickers and labels, and in its original packaging as it was received. You will also bear the cost and risk of returning the Product(s).
It is your responsibility to cancel the order if you believe that the delivery is taking too long. If the order has already been dispatched you will be required to receive the order. Cancellation of your purchase is not valid until this has been communicated and confirmed by FLARROW. If a Product is unavailable FLARROW has the right to cancel your purchase and refund the paid amount. If possible we will notify you of a replacement or any equivalent Products.
Exchanges & Returns
All Products can be returned with a proof of purchase within a 14-day trial period, starting on the day you receive the order. No reason is needed when returning the Product within this trial period and you will receive a full refund of the purchased Product. We will issue the refund within 15 business days by the original payment method for the amount as stated on the original order confirmation. It is your responsibility to notify us of your return shipment within the 14-day trial period. All costs of returning a Product within the trial period are borne by the Buyer and will not be refunded. We recommend you to choose a secure shipment method as the return shipment is at your own risk.
All Products must be returned unworn and unused, in the exact same condition, including the protective stickers and labels, and in its original packaging as it was received. Upon receipt of your return we will carefully inspect the Product for any wear and tear, damages and whether any accessories that belong to the Product are missing. Please contact email@example.com for further instructions on how to process your return.
In case you have received a faulty or damaged Product, you must contact us at firstname.lastname@example.org at your earliest convenience and within 24 hours after receiving the Product(s). In case a faulty or damaged Product that is not caused by the Buyer is returned, we will send back a replacement and you will be reimbursed for your shipping expenses. If you return a Product without having notified us of your return first, you will not be able to claim any costs related to this return shipment.
If you would like to exchange your Product please follow the return process as described above. Unfortunately, due to logistics we are currently not able to directly ship you a different Product in case you are looking to exchange the original Product. Once we have received your return we will issue a refund by the original payment method for the amount as stated on the original order confirmation. Once you have received the refund you can order a different Product.
You will receive a confirmation email with the details of the Product that you have returned as soon as we have received it. Please note that this can take up to 7 business days depending on the country from where it is being shipped. In all cases we advise you to return a Product by insured shipment and in sealed packaging. By doing so you will be able to hold the carrier liable in case an insured return shipment goes missing, gets damaged or in case the reception of a return shipment is denied. Please always keep the receipt that you receive when returning the Product as this contains the tracking information of the shipment and will be your proof that you have returned the Product.
Warranty & Repair
The international warranty term on our Products is two years from the date of purchase. Our warranty only applies to manufacturing defects of the movement and not on regular wear and tear. The following issues are not covered by our warranty and any repair or replacement will be charged:
· Failure or damage as a result of improper use, such as scratches, knocks, dents, crushing, broken crystal;
· Failure or damage as a result of dropping the Product;
· Failure or damage as a result of previous (unjustifiable) repairs or modifications done by a third party;
· Failure or damage as a result of neglected care;
· Failure or damage as a result of fire, water (including showering, swimming, or diving), or a natural disaster (such as an earthquake);
· Esthetic changes as a result of regular wear and tear and aging, such as alteration of the colour of the strap, scratches on the case and/or crystal, and peeling of the plating of the case;
· Failure to submit the warranty along with the watch;
· Battery replacement, also during the warranty term.
The case, dial, hands, crystal, strap, and other parts thereof may be replaced with substitutes if the originals are not available. Within the two-year warranty period you are entitled to receive a free replacement of the same Product. We will only honour warranty claims with the original email confirmation as proof of purchase. We are sorry to hear if you have a complaint about our Products or service. You can contact us using the contact form or you can send us an email. In case of an complaint, please always mention the order number and the reason for complaint. We will get then back to you as soon as possible with a solution.
Liability for Defects
All our Products are carefully inspected before shipment. We do, however, advise you to also carefully check the ordered Product(s) immediately upon receipt. Any damage to Products that may have occurred during transport, whether visible or not, must be reported to FLARROW as well as to the carrier within 24 hours after delivery. You are not entitled to reject a faulty Product after 24 hours from the moment you received the order. Any return of a faulty Product should be treated as if it were faultless. It is important to return faulty Products in its original packaging. You must ensure that Products cannot be damaged during return transit. After receipt and inspection of the faulty Product we will send back a replacement and you will be reimbursed for your shipping expenses. If the Product is not available any more, you will receive a full refund instead.
To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose, non-infringement, title, quiet enjoyment, data accuracy and system integration. This Website may include inaccuracies, mistakes or typographical errors. FLARROW cannot be held liable for any damages of any kind from including but not limited incompatibility, delivery delays, downtime, data loss, additional work, or other economic harm. In any case, our total liability to you for any damages shall never exceed the amount that you paid for your order. FLARROW cannot be held responsible for any delays in the delivery of your order. By using this Website you agree that you order from this Website for domestic and private use only. Products sold on this Website are not for commercial, business or re-sale purpose for which we have no liability to you for any loss of profit or business. The risk of loss and title for items is passed to you as soon as we have received your payment.
FLARROW shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered, or delayed by circumstances beyond its control. As the release factor should be considered included government intervention, new and / or amended legislation, lack of state, war, fire, flood, labour disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions, exposure to criminal activity that affects Production or lack of delivery from suppliers.
Intellectual Property Rights
All content and material, including Product photos and intellectual property rights such as trademarks and copyright, on this Website are owned or licensed by FLARROW. Any use of this content or material other than for personal, non-commercial use is strictly prohibited without the explicit written approval of FLARROW.
This Website may include user-generated content from social media. FLARROW does not claim any ownership of such content and does not take any legal responsibility for it. If you suspect any violation of copyright please contact us at firstname.lastname@example.org
Retention of Title
All Products remain FLARROW’s property until an order has been paid in full.
Any attempt at fraud will be directly reported to the police. FLARROW reserves the right to cancel the purchase if any suspicion of fraud is raised.
Governing Law and Jurisdiction
Dutch law applies to all agreements and legal relationships between FLARROW and the Buyer, regardless of the country from which the Buyer places an order and regardless of the country to which the order will be shipped. To the extent permitted by law, the competent court of Amsterdam shall have exclusive jurisdiction in case of any dispute arising from these Terms and Conditions and the use of the Website.
FLARROW reserves the right to terminate at its sole discretion any account you have opened on this Website. This may be the case if we suspect you may have breached these Terms and Conditions. Termination of your account can be done without any prior notice.
FLARROW may revise the Terms and Conditions from time to time. Whenever you order a Product from this Website, the Terms and Conditions that are then in force will apply to the contract between FLARROW and you. Any updates on the Terms and Conditions can be found on this page. We advise you to read the Terms and Conditions carefully.
